PREMISE
The bicycle company, hereinafter referred to as the 'Company', markets items such as mtb, racing, men's, women's and children's city bicycles, hybrids and the innovative electric bikes distinguished by our brands throughout Italy.
To better respond to consumer expectations, the Company has set up a remote sales system via the Internet for a selection of the items mentioned above. This system is governed by the terms and conditions indicated below as well as by the provisions on distance contracts pursuant to Legislative Decree 206/2005 (Consumer Code) pursuant to which:
I) "online sales contract" means the distance contract, i.e. the legal transaction concerning movable goods and/or services stipulated between a professional, in this case the bicycle shop, through the online service www.labicicletteria.eu and a consumer, in the context of a distance selling system organized by the trader who, for this contract, only uses the distance communication technology known as the Internet;
II) "professional" means the natural or legal person who acts in the exercise of his entrepreneurial, commercial, craft or professional activity, or his intermediary;
III) "consumer" means the natural person of legal age who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out.

ARTICLE 1
FIELD OF APPLICATION
These general conditions of sale govern the sale by the Company to its customers of the items sold through the website accessible at the address www.labicicletteria.eu
The possibility of purchasing items remotely through the sites is reserved exclusively for adult natural person customers, who act as consumers pursuant to Legislative Decree 206/2005 to make a purchase on their own and who are holders of a credit as better defined in the following art. 6.3.
For the above purposes, the consumer expressly declares to purchase the items for personal use outside any professional activity carried out.
The Company reserves the right to modify or update these general conditions of sale at any time and without notice. The consumer acknowledges and accepts that the purchase of the items will be governed from time to time by the general conditions of sale present in the version in force at the time the order is placed through the site. The consumer is therefore required to check the current version of the general conditions of sale before placing the order.

ARTICLE 3
INFORMATION RELATING TO THE ITEMS
The essential characteristic information of the articles (by way of example but not limited to: type, denomination, colour, size, properties, materials, composition, etc.) are available by accessing the sites. However, the consumer is aware and accepts that, although the photographic reproductions and other reproductions of the articles faithfully represent the original products, they are provided by the Company for indicative purposes only and have no contractual value and that therefore the articles, although compliant with the description made by the Company, may not be perfectly identical to those represented in the photographic reproductions or other reproductions.
The consumer therefore accepts that the Company is not held responsible in any way for imperceptible and marginal differences found in the items delivered compared to those represented to the consumer at the time the purchase order is formulated.

ARTICLE 4
ORDER OF PRODUCTS
4.1
In order to be able to purchase the items remotely, the consumer must follow the procedure described in article 5 below.
Orders will be accepted by the Company within the limit of stock availability. The consumer, before the purchase order, will be informed of the limit of stock availability. If, after the formalization of the order by the consumer, it turns out that the requested items are no longer available, the Company will inform the consumer and refund any amount paid according to the indications that the consumer himself will want to provide.

4.2
c) The personal data, address, telephone number and e-mail must be exclusively one's real personal data. It is strictly forbidden for the consumer to enter false, and/or invented, and/or imaginative data in the registration procedure necessary to activate the procedure for the execution of this contract and the related further communications.
d) It is forbidden to enter data of third parties. the bicycle shop reserves the right to legally prosecute any violation and abuse, in the interest and for the protection of all consumers.
e) The consumer indemnifies the bicycle shop from any liability deriving from the issue of incorrect tax documents due to errors relating to the data provided by the consumer, being himself solely responsible for the correct insertion.
The consumer undertakes to place orders in accordance with these general conditions of sale and, in particular, to provide complete, accurate and updated information. Should the Company find that the order does not comply with the provisions of these general conditions of sale (by way of example, but not limited to, orders containing incorrect information about the delivery address), the Company will inform the consumer of such circumstances by e-mail within 6 working days of placing the order, requesting a correction of the order to make it compliant with these general conditions of sale.

4.3
However, the Company will have the right, at its discretion, to refuse:
• orders placed by a consumer with whom there is a dispute relating to the payment of previously sold goods;
• orders that do not comply with these general conditions of sale and have not been corrected by the consumer

4.4
Please note that pursuant to art. 13 of Legislative Decree 30 June 2003, n. 196, the personal data entered on the appropriate page of the site at the time of placing the order will be processed by the Company exclusively for the purpose of completing the sale and delivery of the items and will be kept by the same exclusively to fulfill legal, fiscal and accounting obligations . The provision by the consumer of such data is necessary for the purpose of completing the procedure for purchasing the items. The data controller is the bicycle shop with registered office in Via Statale 11 Stanghella (PD) and second shop in Via Battaglia 199 Albignasego (PD).
The consumer will be able to exercise all the rights recognized by article 7 of Legislative Decree 30 June 2003 such as, by way of example, the right of access to data, the right to update, cancel, rectify, integrate, block data or transform them into anonymous form as well as the right to oppose the sending of commercial information and, in any case, for legitimate reasons, to the processing of your data by contacting the Company directly, without formalities, by e-mail at the address info@labicicletteria.eu or by post.

ARTICLE 5
PRICES OF ITEMS
Item prices are inclusive of all taxes and duties, excluding shipping costs. The price of each item, as well as the amount of shipping costs, are communicated to the consumer before the conclusion of the contract. Shipping costs do not include any customs duties, which are the responsibility of the consumer. All prices are expressed in Euros and include VAT.

ARTICLE 6
PURCHASE METHOD

6.1 – REGISTRATION
By filling in the personal data sheet in the registration procedure requested by the site, the consumer authorizes the bicycle shop to communicate non-sensitive personal data (residence, telephone number) to trusted couriers and/or shippers used for the delivery of the purchased goods, to allow procedures necessary for their delivery.
It is possible to enter any Shipping Notes in the order, such as for example the name of the person to whom the package must be delivered in the event of the recipient's absence.
In this regard, the consumer undertakes to communicate the exact address of his habitual residence or that of the third party.

6.2 - PAYMENT
Once the data has been entered, it is possible to see the summary of the order and choose the type of payment.
After a few seconds, the system will direct you to the site linked to the bank that owns and manages the online payment service, which the bicycle shop will not be able to access in any way.
Payment can be made via PayPal (it accepts any credit card, including the PostePay card) or by bank transfer; while at the moment cash on delivery payments are NOT accepted.

PAYPAL
1. Arrived at the Payment step, select PayPal and click on Complete order.
2. You will be redirected to PayPal, login with your PayPal account email and password. If you don't have a PayPal account click Don't have a PayPal account? you can still pay with your credit card.
3. Complete the payment by clicking on Pay.

BANK TRANSFER
1. Arrived on the Payment step, select Bank transfer and click on Complete order.
2. You will receive an e-mail confirming the creation of the order where you will find all the information to make the transfer.
3. Make the bank transfer to the bicycle shop,
IBAN IT27S0898262910017002992667 IN REFERENCE TO THE BANCADRIA branch of Stanghella and enter the order number (Wxxxxxx/xxxx) and the chosen bike model as REASON.
4. Send the receipt by e-mail to info@labicicletteria.eu specifying the order number, name and surname.
5. It is important that after making the transfer, you send us the receipt as soon as possible. After having carried out the necessary checks, we will send the products you have ordered.

6.3 – ORDER CONFIRMATION
At the end of entering the data relating to the payment card, the system will inform you that the order has been accepted and will send an e-mail confirming the order.
In general, the bicycle shop and the consumer agree that the electronic messages as well as the automatic registration systems will be authentic between the parties as proof of the sending of the purchase order, with particular regard to the nature and date of the order. In any case, it is recommended that the consumer keep a paper or electronic copy of the order sent and of the electronic message sent by the bicycle shop.

ARTICLE 7
DELIVERY
The delivery of the items will be made only:
• in the consumer's usual place of residence or
• to the address of the third party indicated by the consumer for delivery at the time of ordering; please note that this address must correspond to the usual place of residence of the third party beneficiary chosen by the consumer or, failing that, to the address of the company where the third party carries out his work;
• it is understood that it cannot, in any case, be carried out either at hotels or at post office boxes.
The delivery of the items will take place after the payment of the order amount has been registered, at the address indicated by the consumer for delivery. The delivery of the items ordered will be made no later than 30 days following the date of the order.
An invoice will be delivered together with the goods containing the details of the items ordered and the prices applied.

ARTICLE 8
RESERVE OF OWNERSHIP
The Company reserves ownership of the items delivered until full payment of their price by way of principal and interest. Payment is finalized upon effective collection of the price.
In the event of non-payment of the price, even if only partial, the Company may, without any prior formal notice, claim the item(s) that will/will have been/s delivered by the Company to the consumer.

ARTICLE 9
RIGHT OF WITHDRAWAL AND RETURN OF ITEMS
The consumer has a right of withdrawal which he can exercise, without having to justify the reasons, within a period of ten working days starting from the day of receipt of the ordered items. In this case, the consumer, within the aforementioned term, has the right to return the items to the Company, in their original packaging, in perfect condition, complete (accessories, leaflet, guarantee, etc.) and accompanied by a copy of the invoice, all at the address indicated on the invoice.
It will be up to the consumer to keep proof of this return, by returning the items by registered mail or by any other means that indicates the certain date; the return costs will be borne by the consumer.
Reimbursement of the invoiced price of the returned items will be made by crediting the consumer's bank account within and no later than thirty days following receipt of the returned items by the Company.
Items returned incomplete, wasted, damaged, deteriorated or soiled for reasons attributable to the consumer will not be refunded and will not, under any circumstances, give rise to the recognition of a credit equal to the price of the item initially ordered.

ARTICLE 10
CONFORMITY - WARRANTY
The consumer must ensure that the items delivered to him correspond to his order. In the event that the delivered items do not comply with the order forwarded, the consumer must inform the Company within the shortest possible time or, by e-mail sent to the address info@labicicletteria.eu and justify the non-compliance of the item to the order and, subject to agreement with the Company, must return the items in question in their original packaging, in perfect condition, complete (accessories, leaflet, guarantee, etc.) and accompanied by a copy of the invoice , to the address indicated on the invoice.
The return of the article must be made by registered mail or by any other means that indicates the certain date; the return costs will be borne by the Company if the non-conformity of the article with respect to the consumer's order is recognised.
Without prejudice to the specific warranty conditions that may be granted to the consumer on the delivered item, the items are subject to legal guarantees.

ARTICLE 11
INTELLECTUAL PROPERTY LAW
The consumer is prohibited from reproducing the site, in whole or in part, in any format or medium. The figurative and non-figurative items and trademarks, and, more generally, all other trademarks, illustrations, images, designs, models and logos appearing on the articles, their accessories and/or their packaging, whether registered or not, as well as patents, are and will remain for the exclusive use of the Company. Any total or partial reproduction or use of these trademarks, illustrations, images and logos, designs and models, for any reason and on any medium, without the express and written agreement of the Company, is strictly prohibited. The same applies to trademarks or other distinctive signs resulting from the use of trademarks and/or distinctive signs owned by the Company. Likewise, without the prior express and written agreement of the Company, any use that does not comply with this license to use the site and in particular the use of any of the elements that make it up (articles presented, descriptions, prices, data, software, graphics, images, texts, photographs, tools, etc.) for sale or any other direct or indirect commercial use.

ARTICLE 12
LIMITATION OF LIABILITY
For the purposes of these general conditions of sale, the Company cannot be held liable:
• for interruptions or delays due to the execution of maintenance work on the site, technical failures, a force majeure event, the act of third parties or any circumstance, regardless of his will;
• the impossibility of the consumer or the Company to temporarily access the site, due to facts beyond his control, such as cases of computer failure, interruptions in the telephone network, the Internet or failure of the reception material of the consumer of the Internet network.

ARTICLE 13
MAJOR FORCE
The Company assumes no responsibility for failed or delayed delivery due to force majeure or unforeseeable circumstances.
Force majeure events are considered, by way of example but not limited to, riots, insurrection, social unrest, telephone or IT breakdowns or serious damage to the security and operation of the Internet, strikes of any nature and the impossibility of supplying of society.
The Company will inform the consumer of such an event of force majeure within seven days of the occurrence. In the event that this suspension of the performance of the Company's obligations is extended beyond a period of fifteen days, the consumer will then have the option of canceling the order in progress and the Company will refund the price in a short time by crediting the consumer's current account.

ARTICLE 14
ACQUIESCENCE
Failure or delay by the Company to exercise a right or failure or delay in requesting the same to fulfill its obligations on the part of the consumer will in no way imply a waiver of said rights and claims, nor will they prejudice the exercise or the application of the same rights or any other right at any later time.

ARTICLE 15
VALIDITY OF THE GENERAL CONDITIONS OF SALE
The ineffectiveness, nullity or inapplicability of any of the clauses of these general conditions of sale cannot lead to the ineffectiveness, nullity or inapplicability of the remaining general conditions of sale, the latter remaining fully valid and effective between the parties.

ARTICLE 16
APPLICABLE LAW - JURISDICTION
Any dispute relating to the application, execution, interpretation and violation of the purchase contracts stipulated through the website www.labicicletteria.eu is subject to Italian jurisdiction; although not expressly provided for herein, these general conditions refer to the rules established by the Civil Code, as well as by Legislative Decree 206/2005.
For any dispute between the parties regarding this contract, the Court in whose district the consumer is domiciled will be competent; for all other disputes, the Court of FERRARA will have exclusive jurisdiction.

RIGHT OF WITHDRAWAL

The purpose of la bicicleria ("the Seller") is to ensure your complete satisfaction. If for some reason you are not satisfied with your order, you can exercise your right of withdrawal, without any penalty, within 30 calendar days from the day you received the products purchased on labicicletteria.eu. The products to be returned must be delivered to the courier that the Seller himself will send directly to your address. The return shipment is completely borne by the Seller as it offers you the free return service within and no later than 30 days from the arrival of the material. The products can be returned only after completing the return request. To complete the request, you must access your account and then click on Return practices management; if instead you are a non-registered user fill out the form
However, it is not possible to exchange the chosen product for another one.

CONDITIONS FOR THE EXERCISE OF THE RIGHT OF WITHDRAWAL
The right of withdrawal is understood to be exercised correctly if the following conditions are fully respected:
– the return request must be completed within 30 calendar days from the delivery date;
– the products must not have been used, worn or damaged;
– the identification tag must still be attached to the products;
– the products must be returned in their original packaging;
If you have complied with all the required conditions, the Seller will refund you the price of the products purchased. You will be contacted if your return cannot be accepted because it does not comply with the above conditions. In this case, you can choose to have the purchased products back at your expense. If you refuse this shipment, the Seller reserves the right to withhold the products and the corresponding amount for the purchase of the products.

REFUND TIMES AND METHOD
After the Seller has received your return and checked that all the requirements have been met, you will receive a return acceptance confirmation email. Whatever method of payment you used (credit/debit card or cash on delivery), the refund is activated by the Seller as soon as possible, and in any case within seven (7) calendar days from the date on which it was become aware of the exercise of your right of withdrawal, once it has been verified that the withdrawal has taken place in compliance with the conditions set out above.
The effective time for the re-credit or return of the sums paid by you for the purchase of the products depends on the payment methods used:
– purchase by credit/debit card: the repayment time depends on the credit/debit card company, but usually takes place within two bank statements. We remind you that the value date of the re-credit is the same as the debit, therefore you will not suffer any loss in terms of bank interest.

PRODUCT IDENTIFICATION CARD
All products offered for sale by the Seller are provided with an identification tag, which forms an integral part of the goods. We invite you to try the product without removing the tag because returned products without one will not be accepted.

COURIER SERVICE
For the return of the products, the Seller will bear the cost of sending the courier directly to your address. You will not have to face any economic expense as the bicycle shop offers a free return service.

RETURNS

You can make a free return within 30 calendar days from the delivery date of your order. The return is free of shipping costs, we will take care of everything. The only terms to be observed for the return are:
the items to be returned must be carefully packed as they were delivered to protect them from transport;
must not be damaged or used;
must be returned with the appropriate identification tag and in their original packaging.
How to proceed to make a return on labicicletteria.eu:

1 – FILL IN THE RETURN FORM
Registered user. If you are a registered user, click on the Login item at the top left of the labicicletteria.eu home page and enter your data in the appropriate window. After logging in to your account, you can carry out the return procedure by clicking on Return procedure management and then Open the return procedure. Select the order you wish to return, the items inside and indicate the reason why you are returning them. Wait for the confirmation email and print the document with the data relating to the return procedure which will be inserted inside the package.
Unregistered user. If you are not registered on labicicletteria.eu, fill out the form by entering your email and the order number on the tax receipt. Select the items you wish to return and indicate why you are returning them. Wait for the confirmation email and print the document with the data relating to the return procedure which will be inserted inside the package.

2 – PREPARE THE PACKAGE
Insert the products to be returned inside the package, complete with the original packaging and identification tag together with the document with the data relating to the return procedure.
Close the package and make sure it is properly sealed.

3 – DELIVERY OF THE RETURN
Wait for the courier to arrive and deliver the package. The courier will pick up your return free of charge at the address you specified within 24/48 hours of starting the return procedure.

4 – GET YOUR REFUND
Once we have received and checked your return, we will refund the returned items. You will receive an email confirming receipt of the package and the refund. The refund will be made within 7 working days from the moment you send us the package. The refund of the amount you paid will depend on the payment methods used:
purchase by credit/debit card. The sum will be credited back to the card according to the repayment times by the credit/debit card company;
cash payment on delivery or bank transfer. The refund is made to the current account you indicated (IBAN) by email to info@labicicletteria.eu specifying the number of the return file.
labicicletteria.eu reserves the right to refuse returns communicated or sent after the pre-established period or those items that do not present the same conditions of receipt.

SHIPMENTS

How the shipments of the items ordered on the site work.

SHIPPING COST
The transport cost is determined primarily on the basis of the weight of the products purchased. At the time of purchase, before final confirmation, you will be shown the shipping costs for the selected products.
For shipments on national territory: Italy, San Marino and Vatican City, the shipping cost is free.

AVAILABILITY
Product availability is always indicated on the product detail page. There are different levels of availability:
– Product available: you can order it and it will arrive at your home in a short time.
– Incoming product: the product is not in stock but if you want to be informed when it becomes available again, you can enter your email address and you will be notified as soon as the product is back in the catalogue.

SHIPPING TIMES
labicicletteria.eu guarantees, depending on the availability of the product in the warehouse, the shipment within an interval ranging from 4 to 7 working days. Delivery times may be delayed in the event of holidays or technical problems. The products will still be delivered within and no later than 30 days.

How is this time estimated?
In addition to availability, the time needed to manage the order must also be taken into account. The orders with the fastest delivery are those made with online payment (Credit Card and PayPal) and with the Express Courier delivery method.

Different payment methods and delivery methods may change the shipping time. For example, for orders with delayed payment, such as bank transfers, the shipping date may vary by a few days, as these orders are processed upon receipt of payment confirmation.

Once you have placed your order and selected your preferred payment and delivery method, one of our employees processes your order and entrusts the product to the courier for delivery to your home.

DELIVERY METHODS
When does the courier arrive? I was not at home and I could not collect the package, what do I do now?

labicicletteria.eu allows you to choose the delivery method you prefer and which best meets your needs.
If you are not present at the time of delivery, the courier will leave you a notice and will try to contact you by telephone to make an appointment with you for a redelivery. If you are unable to reach an agreement with you by telephone, you will open a stock and at that point we will contact you by email to notify you of the stock of your package. The package will remain in storage for a maximum of 10 days and will then be automatically sent back to our office.
